THINK. Basketball IQ App Terms of Service

1. Introduction

THINK. (“we”, “us”, or “our”) provides the THINK. mobile application and website (collectively, the “Service”) to help basketball players and enthusiasts develop their Basketball IQ. These Terms of Service (“Terms”) govern your access to and use of the Service.

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by them. If you disagree with any part of these Terms, please discontinue use of the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into a binding agreement
  • Your use of the Service complies with all applicable laws and regulations in your jurisdiction

If you are between 13 and 18 years of age, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Creating an Account

  • Accurate information: You agree to provide accurate, current, and complete information during registration and to keep it up to date
  • Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
  • One account per user: You may not create multiple accounts or use another person’s account without permission

3.2 Third-Party Sign-In

  • Sign-in providers: If you register or log in using Apple, Google, or another third-party service, you authorize us to access basic profile information in accordance with that provider’s terms and privacy policies

4. Subscriptions and Payments

4.1 Free and Paid Plans

The Service may offer free and paid subscription tiers. Features available under each plan are described within the app and are subject to change with reasonable notice.

4.2 Billing

  • Charges: Paid subscriptions are billed in advance on a recurring basis (monthly or annual) through your chosen payment method or app store platform (Apple App Store, Google Play)
  • Renewals: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period
  • Price changes: We will provide reasonable advance notice of any pricing changes before they take effect

4.3 Refunds

  • Refund eligibility is determined by the platform through which you purchased (Apple App Store or Google Play) and their respective refund policies
  • For direct purchases, please contact us at hq@think.basketball to discuss refund requests

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Service to transmit spam, harmful, or offensive content
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access or extract content from the Service
  • Reproduce, distribute, or commercially exploit any content from the Service without our express written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate accounts that violate these restrictions.

6. AI Coach Feature

The AI Coach feature provides personalized basketball coaching responses based on your inputs. You acknowledge that:

  • AI-generated responses are for informational and educational purposes only and do not constitute professional sports, medical, or fitness advice
  • You are solely responsible for how you apply any guidance provided by the AI Coach
  • We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific situation

7. Intellectual Property

7.1 Our Content

All content available through the Service — including lessons, quizzes, graphics, text, AI-generated coaching content, logos, and software — is the exclusive property of THINK. or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes.

7.2 Your Content

  • Ownership: You retain ownership of any content you submit to the Service, including messages sent to the AI Coach
  • License to us: By submitting content, you grant THINK. a non-exclusive, royalty-free license to use, process, and analyze that content solely to provide, improve, and develop the Service

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, THINK. and its officers, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other legitimate business reason. You may terminate your account at any time by contacting us at hq@think.basketball. Upon termination, your right to use the Service will immediately cease, and provisions of these Terms that by their nature should survive termination shall remain in effect.

12. Third-Party Services

The Service may contain links to or integrate with third-party services (e.g., Apple, Google, Firebase). These Terms do not apply to those third-party services. We encourage you to review their respective terms and policies before use.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Latvia, unless otherwise required by mandatory local consumer protection law in your jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, by sending you a notification through the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
